Strongback Limited Consumer Warranty

The frame of your new Strongback Mobility transport wheelchair is guaranteed for 2 years against defects in manufacturing and materials. The seat, footrests and other auxiliary parts are guaranteed for 12 months. The warranty does not cover defects or deterioration due to normal wear or damage due to misuse, alteration, tampering, negligence, accidents, unauthorized repair, or any other cause beyond the reasonable control of Strongback Mobility. The defective product must be returned to Strongback Mobility with a return authorization. If, after inspection, the product is defective, it will be replaced free of charge. Except for this Limited Consumer Warranty THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, OF PRODUCTS FURNISHED HEREUNDER OR IN CONNECTION HEREWITH. STRONGBACK MOBILITY CLAIMS ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO REPRESENTATION OR OTHER AFFIRMATION OF FACT, INCLUDING BUT NOT LIMITED TO STATEMENTS REGARDING CAPACITY, SUITABILITY FOR USE OR PERFORMANCE OF PRODUCTS, WHETHER MADE BY STRONGBACK MOBILITY REPRESENTATIVES OR OTHERWISE, WHICH IS NOT CONTAINED HEREIN, SHALL BE DEEMED A WARRANTY BY STRONGBACK MOBILITY OR GIVE RISE TO ANY LIABILITY OF STRONGBACK MOBILITY. UNDER NO CIRCUMSTANCES SHALL STRONGBACK MOBILITY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST SALES OR LOST PROFITS) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL STRONGBACK MOBILITY’S TOTAL LIABILITY EXCEED THE TOTAL AMOUNT RECEIVED BY STRONGBACK MOBILITY FROM THE VENDOR FOR ANY PRIOR SIX (6) MONTH PERIOD.
